Takeda Pharmaceuticals International Ltd. has been found guilty of violating the Food, Drug and Cosmetic Act and unfair trade practice laws by marketing and selling unlicensed, unapproved products.
According to a complaint filed in the United States District Court for the District of Delaware, Takeda Pharmaceuticals International Inc., sold unapproved products that were not licensed by the United States Food and Drug Administration (FDA).
The complaint said Takeda promoted unapproved Viagra, the active ingredient in the erectile dysfunction drug Viagra, for its use in the treatment of ED, a condition known as erectile dysfunction.
Takeda also promoted a product called Cialis which was a prescription medication for a disorder that is associated with erectile dysfunction. Cialis was marketed as a treatment for impotence.

The complaint said Takeda "failed to adequately warn physicians and consumers of the possible risks of the unapproved use of Cialis."
According to the complaint, Takeda's marketing and sale of the unapproved Cialis product "were motivated by a desire to lower the cost of Viagra and other erectile dysfunction treatments."
Takeda's sales representatives "directly directed the consumers to a product marketed to them as having little or no benefit from the drug, which they did not have prior knowledge of."
The complaint said Takeda "directly encouraged consumers to purchase and use the product, even though the product was not a licensed product."
Takeda also made a series of purchases in which the product was advertised to be for ED, such as "Viagra for men" and "Viagra for women" to treat men with ED.
